Terms of service

1. Overview

This website and online store is operated by Retro Orbit ("we", "us", "our"). By visiting the store or buying from us, you agree to these Terms of Service ("Terms"), together with our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the store. Our store is hosted on Shopify, which provides the e-commerce platform that lets us sell to you.

2. Eligibility

You must be at least the age of majority where you live, or have the consent of a parent or guardian, to place an order. You agree to give us accurate, complete and current information when you buy from us.

3. Products

We do our best to describe and photograph our products accurately. Colors can look slightly different on different screens, and packaging may change without notice. Specifications, battery life and the number of games are approximate and can vary with settings, software version and how the device is used.

4. Prices and payment

Prices are shown in U.S. dollars unless your local currency is displayed at checkout, and include free shipping to the countries we serve. We may change prices at any time, but a change won't affect an order we've already accepted. Payments are processed securely by our payment providers; we never see or store your full card details.

5. Orders

Your order confirmation email confirms that we've received your order; it isn't an acceptance. We accept your order when we ship it. We may limit quantities or decline or cancel an order — for example, if a product is unavailable, a price was shown in error, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.

6. Shipping, returns and refunds

Delivery times and costs are described in our Shipping Policy. Returns, exchanges and refunds are described in our Refund Policy.

7. Discount codes and promotions

Discount codes can be used once per customer unless stated otherwise, can't be combined with other offers, have no cash value and can't be applied to past orders. We may change or end a promotion at any time.

8. Errors

Occasionally the store may contain typographical errors or inaccuracies in product descriptions, pricing or availability. We may correct them and update information at any time without prior notice, including after you have placed an order.

9. Intellectual property

The content of this store — including text, graphics, logos and images — belongs to Retro Orbit or its licensors and may not be copied or reused without our permission. Other product names and trademarks mentioned belong to their respective owners and don't imply endorsement.

10. Your comments and feedback

If you send us reviews, ideas or other feedback, you allow us to use, edit and publish it without compensation. You agree not to submit anything unlawful, abusive or that infringes anyone's rights.

11. Prohibited uses

You may not use the store for any unlawful purpose, to infringe others' rights, to upload malicious code, to collect other people's personal information, to interfere with the store's security, or to place fraudulent orders.

12. Third-party services

Some features (such as payments, shipping and tracking) are provided by third parties. Your use of those services is also subject to their terms, and we aren't responsible for their content or practices.

13. Disclaimer and limitation of liability

To the fullest extent permitted by law, the store is provided "as is", and we aren't liable for indirect, incidental or consequential losses arising from your use of the store or our products. Where our liability can't be excluded, it is limited to the amount you paid for the product concerned.

Nothing in these Terms excludes or limits rights you have under the consumer protection laws of your country, including the Australian Consumer Law, Canadian provincial consumer protection laws and Mexico's Federal Consumer Protection Law.

14. Indemnification

You agree to indemnify Retro Orbit against claims arising from your breach of these Terms or your misuse of the store.

15. Termination

These Terms apply until ended by you or us. We may suspend access to the store if we reasonably believe you've broken these Terms. Sections that by their nature should survive termination will continue to apply.

16. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without affecting any mandatory consumer protections of the country where you live.

17. Changes to these Terms

We may update these Terms from time to time. The version posted on this page applies to orders placed after it is posted.
